Q: Are there any legal issues when a company implements a "return to work" policy, but applies it inconsistently?
Employer has implemented a "return to work" policy, requiring all employees to be present in the office a minimum of X days per week.
The policy is not applied consistently, managers have discretion to apply this policy as they see fit. The application of this policy is inconsistent among employees with the same job title, it appears everyone has a unique set of rules. The unique rules per employee don't accomodate situations such as work location & travel distance, they seem to be applied using the "buddy system".
