Baltimore, MD asked in Personal Injury for Maryland

Q: I was tackled by a police officer right outside the Walmart entrance for stealing baseball cards.($24) My Hip was Broke.

The office did not identify his self or say Stop. I'm currently in a Medical Rehab center because my Hip was broken do to being Tackled. I've been here 3 weeks and counting.

A: Are you admitting to committing a crime because there is evidence (eye witness, video surveillance or the like) that you possessed the baseball cards without evidence of payment? While I suppose one might argue that excessive force was used and was unnecessary, it's likely a matter of your word against that of the undercover Officer concerning any identification/lack of identification and how your injury occurred. But think of the situation this way... if you filed a claim and went to court, how likely is it that a judge or jury would show sympathy to someone who can be proven a thief? I regret - at least from my perspective - there little reason to believe you will achieve success pursuing a claim against either the individual who allegedly injured you or the store at at which he was employed. Reward a thief for the consequences of an over zealous detention? Regrettably, I'm uncertain most attorneys would find your potential claim attractive.
