Houston, TX asked in Child Custody, Child Support, Divorce and Family Law for Texas

Q: what can I do? If my former spouse had me served at a different location and had somebody sign my paperwork

I did not know about my court date due to the fact she had me serve somewhere else now they say now they put me on back child support and she moved and won’t give me her address to see my kids

1 Lawyer Answer

A: It depends on the status of the court proceeding and, if a judgment has been signed, how long it has been since the judgment was signed and when you first acquired actual knowledge that a signed order was entered against you.

You need to obtain your court records (most of which are available online in most Texas counties) and schedule an appointment with an experienced attorney in or near the county where the court proceeding is pending.

Your options include:

1. Filing an answer

2. Filing a de novo appeal from an AJ's ruling

3. Filing a motion to vacate temporary orders

4. Filing a motion to set aside a default judgment

5. Filing a motion for new trial

6. Filing a notice of appeal

7. Filing a Rule 306a motion to extend time because of no notice of judgment

8. Filing a restricted appeal

9. Filing a bill of review

10. Filing a motion to modify in suit affecting the parent-child relationship
