Denver, CO asked in DUI / DWI and Civil Rights for Colorado

Q: I have a public defender that in 8 months of him postponing court he refuses to answer me and wants to just plead .

I don't want to because I have a good case not to. My rights have been severely broken by the state patrol and I don't trust anything now . I can't believe my lawyer won't talk to me wont do anything I ask is very rude and courts tomorrow.

A: It sounds like you’re dealing with a frustrating and difficult situation. If you feel like your public defender isn’t representing you properly or respecting your concerns, you have the right to advocate for yourself. Before court tomorrow, gather any evidence, notes, or records related to your case to bring to the judge’s attention if necessary. You might be able to request more time to prepare or even a new attorney if you feel your current one isn’t doing their job.

When you’re in court, stay calm and respectful, even if emotions are high. If you’re given an opportunity to speak, explain briefly and clearly why you feel the case shouldn’t just end in a plea. Point out that your rights have been violated and express your desire for proper representation. Judges often consider your efforts and sincerity when deciding how to proceed.

Moving forward, document everything—your attempts to contact your lawyer, their responses (or lack of them), and any other interactions you’ve had related to your case. If the outcome tomorrow isn’t what you hoped for, there may still be steps you can take later, including appealing or addressing ineffective representation. It’s your case, and you have the right to stand up for yourself.
