Q: neighbor is complaining about a branch from our tree hanging over his garage. He wants us to have it cut . Are we liabl?
Said he wants us to pay to get it cut away from his garage.he’s worried it might fall on his garage/house in a storm. It is a live branch growing over our fence. About 15 years ago he cut down limbs on his own, from same tree ( not over garage area )
Said if we don’t do it he will contact a lawyer .
A: A Kansas attorney could advise best, as each jurisdiction can have specific rules involving trees, but your question remains open for three weeks. Until you are able to discuss with a local attorney familiar with state-specific statutes regarding trees, as a general point, I'd say it could be worth considering your neighbor's legitimate concerns. If your tree was to cause damage, your homeowner's insurance could raise the issue that you did have notice of the risk created by the tree rooted in your property. You may want to discuss further with local attorneys. Good luck
