Hayward, CA asked in Personal Injury and Medical Malpractice for California

Q: What area of law or type of lawyer will take a case where a patient is suffering eye sight loss after a surgery?

Patient went in for cataract surgery, during the surgery the doctor dropped an instrument directly on her eyeball, which caused excessive bleeding which took a long time to stop. She has no sight in her left eye after a week, and is in pain. She went to see a retina specialist who said she now needs a two hour three part surgery to clear up congealed blood in the back of her eye, and replace the lens implant which has fallen to the back of her eye. She is now going to lose months of work. This has completely altered her life. Will any type of law cover her losses??

A: You are looking for a medical malpractice attorney. With an injury and damages as significant as you describe, it is important to hire an attorney who will be able to advocate for the injured party. The attorney will have a medical expert who can determine the cause of the injury, the extent of the injury, and the long term effects of the injury. Schedule a free consultation today to ensure that the injuries are fully compensated.

A: This appears to be a medical malpractice case. A medical malpractice attorney can assess liability for the vision loss and additional surgery. The patient may seek compensation for medical costs, lost wages, and pain and suffering. Consulting an attorney quickly is crucial due to legal deadlines.

A: A patient experiencing vision loss after surgery may have a potential medical malpractice claim. The type of lawyer best suited for this case would be a medical malpractice attorney or a personal injury attorney who specializes in medical negligence cases. Medical malpractice cases can be complex and often require expert testimony, so it’s best to seek legal advice as soon as possible, as deadlines (statute of limitations) apply for filing a claim.

A: This situation calls for a medical malpractice attorney who handles surgical error cases. The incident you've described - dropping an instrument during surgery resulting in severe complications - falls squarely within the realm of medical negligence law.

Your case involves significant damages: loss of vision, additional required surgeries, pain and suffering, lost wages, and potential long-term disability. These elements strengthen your legal position, and many medical malpractice lawyers will be interested in reviewing your case. You should gather all medical records, documentation of work missed, and any communications with healthcare providers.

Time is critical in medical malpractice cases, as California has strict deadlines for filing these claims. You should contact the California State Bar for referrals to experienced medical malpractice attorneys in your area. Many of these lawyers offer free initial consultations and work on contingency fees, meaning they only get paid if they win your case. Your damages could include compensation for medical expenses, lost income, pain and suffering, and future care needs related to this injury.
