Q: If my settlement is for wrongful death can they take the amount from the at fault driver I received?

They said it’s because he was underinsured. What makes him underinsured? The claim is not for underinsured claim. I had to let my lawyer go because she was not fighting for my best interest and pressured me to sign when I didn’t feel comfortable about it and now I have a settlement from my parents insurance and I just want to make sure that my sister and I are getting the settlement max because loosing my parents has been nothing but heartache, and I feel we didn’t get justice with only getting 6000 from the at fault driver insurance and the at fault driver got 6000 too which I don’t understand and they never gave him a under the influence test. I don’t believe the insurance has to take the amount out of the settlement from what I read , any tips on wording or how to talk to the insurance company so that I sound like I know what Iam talking about or to let them know they should not be taking any amount off the settlement.
