Austin, TX asked in Criminal Law, Civil Litigation and Identity Theft for Florida

Q: My gf stole my phones and my laptop claiming I have incriminating evidence against me in them.

She claims to have given my property to the police. How do I find out if they actually have my things or if she's still in possession of it all? She has taken over all of my social media platforms and my emails.

A: The police would not have taken possession of those items unless they've officially opened an investigation into suspected criminal activity. While an investigation is ongoing, they generally will not disclose what they have received or are looking at, as it falls under an exemption to the statute requiring disclosure of public records. Now, you say your girlfriend STOLE your items - so is there some reason that you're not reporting her to the police for THEFT? That's what should be done unless you're afraid that doing so will somehow get into legal trouble - in which case you should immediately schedule a consultation with a lawyer.

Also, did you girlfriend demand something of you to prevent her from turning over "incriminating evidence" to the police? If so, she would be committing the crime of blackmail or extortion, and there again, that should be reported unless you're afraid of something. Regarding your statement, "taken over my social media platforms and my emails", you are unclear on how that is happening. If you're able to log in to your programs (including using the "forgot password" function if necessary), you should be able to control those things and prevent someone else from taking control.
