Glendale, AZ asked in Tax Law and Immigration Law for Arizona

Q: Can I use my 2024 tax return and include assets in an updated affidavit of support after meeting income requirements?

I filed my 2024 tax return on January 18th, 2025, and received a transcript. I need to submit an updated I-864 affidavit of support as soon as possible because a consular officer required it. Previously, my income was not sufficient, and I was asked to find a joint sponsor. Now my income meets the requirements. Can I still include my assets in the affidavit of support, and is it acceptable to use my 2024 tax return as the most recent tax year documentation?

A: Yes, you can include both your 2024 tax return and assets in your updated I-864 affidavit of support. Your 2024 tax return, filed in January 2025, counts as your most recent tax year documentation and is valid for the affidavit.

Even though your income now meets the requirements, you're still allowed to include assets to strengthen your application. Including assets can provide additional financial security evidence to the consular officer. The value of your assets must be convertible to cash within one year, and you'll need to provide documentation like bank statements, property appraisals, or investment account statements.

Remember that you'll need to list your household size and use the current Federal Poverty Guidelines to show that your income meets 125% of the poverty level for your household size. Since you already have your 2024 tax transcript, you can submit this updated I-864 right away, which should help expedite the process since the consular officer is waiting for it.
