Q: Impact of payment on statute of limitations for credit debt lawsuit in TX
I was sued for a credit debt in Texas. The account went into default in September 2020, as the terms of the credit agreement state that a default occurs when the amount due, as listed on the monthly statement, is not paid. A small payment, which did not satisfy the default, was made in February 2021. I recently received a legal notice about this on February 14. The exhibits attached to the lawsuit are cut off and not fully visible. How does this payment affect the statute of limitations for the debt in Texas, and are there any specific laws related to resetting the statute of limitations? What are my chances of dismissal or winning the suit?
