Q: Steps to get power of attorney for my elderly mother in Texas?
I am looking to obtain both medical and financial power of attorney for my elderly mother, who is currently able to make her own decisions. She does not have a will or any other estate planning documents but understands the importance of assigning me as her power of attorney. What are the steps and paperwork required to accomplish this in Texas?
A: As an estate planning attorney, I would always recommend that you have an attorney assist her just to understand the documents fully and whether there is a need for any modification to the form based on the statute. You can search for Texas Statutory Durable Power of Attorney and Texas Medical Power of Attorney and likely find them online for free. I would encourage her also to complete a Healthcare Directive, sometimes called a living will, that lays out on paper what her desires are related to end-of-life care in the event she ends up in the hospital with a terminal or irreversible condition.
