Queens, NY asked in Employment Law for New York

Q: Legal advice needed for unpaid overtime and shift cancellations at a security company at JFK Airport in NY.

I am seeking legal advice regarding ongoing issues at my security company. For the past two months, I've experienced several problems, including unpaid overtime, last-minute shift cancellations (often within 4 hours of the shift), and incidents where, after clocking in, I was informed that my shift had been given to someone else. Despite bringing these issues to my employer, I’m met with no comment or vague promises to escalate to management, but no resolution follows. Several other employees are facing similar challenges. What legal actions can I pursue to address these issues?

A: I am sorry to hear about situation. You have a number of options, including filing a complaint with the NY State or Federal Department of Labor and consulting with an plaintiff's wage and hour attorney about a possible lawsuit. Many overtime attorneys will provide a free initial phone consultation. You should consider the value of your claim before putting yourself on your employers radar. Retaliation for filing a DOL complaint or a lawsuit is illegal but it does happen. I wish you the best of luck.
