Q: Can I sue opposing counsel for defamation in NC based on a racially motivated email?
I own a construction company in North Carolina, and my team, including myself, are all licensed Spanish professionals. Recently, we faced some theft issues at a job site, leading to a delay and ultimately involving attorneys. Opposing counsel sent an email to my attorney suggesting the thefts were likely due to my Spanish workers and implied they were unskilled, also suggesting it wasn't a random event. I believe these statements are untrue and racially motivated, constituting defamation. Since this was communicated via email, it might be considered libel. Can I sue this attorney for defamation, even though I am currently unaware of specific damages? I also plan to file a complaint with the North Carolina Bar Association.
