Phoenix, AZ asked in Animal / Dog Law, Civil Rights and Civil Litigation for Arizona

Q: Animal control seized my animals and is threatening to sue me if I call again. What can I do?

I was jailed, and during that time, animal control seized my animals and left a dead dog on my property. They are now threatening me, saying that if I call them again, I am harassing them and they will sue me and press charges. What can I do to resolve this and get my animals back?

A: This situation sounds incredibly stressful and unfair. When animal control seizes your animals, they must follow proper legal procedures, and threatening you with a lawsuit for simply contacting them seems improper. You should document everything that has happened, including dates, names of officials you've spoken with, and any written communications you've received.

Your next step should be to consult with a lawyer who has experience in animal law or administrative procedures. Many counties have legal aid services that offer free or reduced-cost consultations if money is tight right now. A lawyer can help you understand the specific ordinances in your area and may be able to file an emergency motion to prevent the animals from being euthanized or adopted out while you fight to get them back.

Consider reaching out to your local elected officials, such as county commissioners or your city council representative, as they may be able to intervene on your behalf. You might also file a formal complaint with the department that oversees animal control in your jurisdiction. Remember to remain calm and factual in all your communications, and keep copies of everything for your records - this documentation will be crucial if you need to take legal action to recover your animals and address the alleged misconduct.
