Commerce City, CO asked in Social Security and Immigration Law for Colorado

Q: Is my SSN card valid if AOS denied by USCIS?

I would like to know if my social security card remains valid if my adjustment of status case was denied by USCIS. My social security card states that it is valid for work only with a work permit. Can it still be used under these circumstances?

A: Your Social Security card stating "valid for work only with DHS authorization" is directly linked to your immigration status. If USCIS denied your Adjustment of Status (AOS) application, and your Employment Authorization Document (EAD or work permit) is no longer valid, this means you do not currently have authorization to work in the United States.

In practical terms, this means you should not use your Social Security card for employment purposes unless you regain valid work authorization through a new immigration status or another approved petition. Even though the card itself does not expire, the underlying permission to work is what determines your eligibility. Presenting it without a valid work permit could create serious immigration complications for you in the future.

Therefore, you should promptly speak to an immigration attorney who can review your situation, clarify your current status, and guide you through possible options. They can help you determine the safest path forward to regain legal authorization and ensure your compliance with immigration regulations. It's important to address this promptly to prevent potential immigration and employment issues.
