A: When filing your I-751 with a petit theft charge, include your electronically certified court record showing that you completed the MIP program and that your case resulted in a Notice of Administrative Nolle Prosequi. You should also attach the certified Clerk’s Certificate of Disposition, as this officially confirms the final outcome of your case. Providing the probation officer's email confirming closure of your MIP case and the community service hours worksheet will further support your good faith and compliance with court conditions.

If your expungement process completes before submission, you must provide an official letter from the court indicating the case was successfully expunged. Even if your record is expunged, USCIS requires disclosure, so you must still submit the expungement documentation to ensure transparency. Including the case history from your county's website can reinforce consistency in your documentation.

When answering "Yes" to Part 20, clearly summarize the incident and explain the outcome, highlighting your completion of court requirements and the final resolution (nolle prosequi and/or expungement). Emphasize your rehabilitation and responsibility by detailing the proactive steps you've taken, such as completing the MIP program, probation compliance, and community service. Maintain honesty and clarity, ensuring your explanation matches precisely with the submitted documentation.
