Boise, ID asked in Landlord - Tenant, Domestic Violence and Real Estate Law for Idaho

Q: How to exit lease with ex-boyfriend refusing to sign off in Idaho?

I am currently on a lease with my ex-boyfriend that ends in July, but I no longer live in the rental due to his emotional abuse. I have the opportunity to pay $250 to get out of the lease, but my ex-boyfriend and his roommate need to sign off on it, and they are refusing to do so. What can I do to resolve this situation?

A: If your ex-boyfriend and his roommate are refusing to sign off on the lease termination, the situation becomes more complicated, but there are still ways forward. You are legally responsible for the lease, but you may be able to negotiate with the landlord for an easier exit. If the landlord is offering you the option to pay $250 to terminate the lease early, it might be worth explaining the situation in more detail to them, especially if you're facing emotional abuse.

If the landlord understands your circumstances, they may be willing to let you move out without needing the signatures of your ex and his roommate. It’s important to keep open communication with the landlord and show that you're trying to resolve the matter responsibly.

If that doesn't work, you may want to consider your legal options. Seeking advice to understand your rights and how to minimize potential liability for the remainder of the lease might be necessary. In any case, keep detailed records of all your communications with both the landlord and the other tenants involved.
