Q: Is it legal for a Virginia property listing to omit tenant-occupied status?

I am a tenant in Virginia residing in a property that is currently up for sale. The listing does not mention that the property is tenant-occupied or that there is a need to respect tenant privacy. I've experienced disturbances, such as a showing arriving early and peering through windows, and a vehicle sitting in our driveway late at night. Neighbors have also reported seeing vehicles on the property when we were not present. We've communicated our concerns to the real estate agent and property management team via text and email, but our lease does not include any agreements or disclosures about the property's sale. Our lease states we should receive 24-hour notice for showings, and I've been a tenant for over four years, with one month remaining on the lease. I'm planning to email the real estate agent to document these issues but am concerned about support from the Lynchburg board of realtors regarding my complaints. Is it legal for the listing to omit that the property is tenant-occupied?

A: The Lynchburg Board of Realtors has no say in such matters. Your contract is between you and your landlord, and it is enforceable. Maybe you need a lawyer to write a letter for you about that after reviewing the lease.
