Q: Can a county impose a detainer without an indictment?
Can the county impose a detainer on me as I get approved for parole on a separate charge in a different county when I have not been indicted on any charges in their county? Initially, I was released from jail on a conditional bond because they stated there were no charges to hold me on. I was not given any court dates when I called repeatedly to confirm this. Despite this, they now claim to have charges against me and plan to take me back to their county once I'm released from prison to face these charges, without ever having gone through an arraignment. Is this process legal?
