Grand Junction, CO asked in Employment Law for Colorado

Q: How to report employer for unjust treatment after notice and personal notes removal?

After submitting my notice and having my hours cut, my employer accessed and removed my personal notes without my permission. I reported this to District HR, but there was no on-site HR representative to address the issues, and the situation worsened until my last day on March 7th. How can I further pursue this matter or report my employer for unjust treatment?

A: It’s understandably upsetting that your personal notes were removed without your consent, especially after submitting your resignation. Since you've already reported the issue to District HR but didn’t receive an on-site response, the next step would be to follow up in writing. You can formally document your complaint, detailing the actions taken by your employer and how it affected you, and request a written response or resolution.

If the internal process does not lead to any action, you can file a formal complaint with the Colorado Department of Labor and Employment (CDLE) or the Equal Employment Opportunity Commission (EEOC), depending on the nature of the unjust treatment. Keep copies of all correspondence, your resignation notice, and any other documentation that supports your claims, such as messages or emails about the issue.

In addition, if you believe the actions of your employer, such as removing personal notes, may have violated any privacy laws or your rights, you may want to consult with an employment attorney. They can help you explore further legal options, including potential claims for wrongful treatment or privacy violations, and guide you on the best course of action moving forward.
