Q: My adult daughter was in an accident driver her Grandmothers car. She was cited for the accident. She is insured under
my policy. Would they sue her or me or both?
A: They would sue her and possibly her grandmother for negligent entrustment is there are facts suggesting her grandmother should have known your daughter was a reckless or unfit driver.
A: If they handle it as only a claim without going into suit, it would be a claim under your insurance. If they place it into suit, the driver and the registered owner is usually named in the suit- knowing that the registrant doesn't have liability. That's just the way it's done in most places.
