Q: Is my son responsible to act on a civil summons that was not directly served to him?
My daughter, 39 y/o, was met at my door and asked if my son was home. She said 'he was busy'. She was then handed a document that says 'District Court Civil Summons' with the District Court, El Paso County, Colorado. The Defendant was listed as her brother. She was told to deliver the document to her brother.
It is going to be hard to locate her brother as he has not lived in the area for over a year.
The document says that if the summons is not responded to (the actual wording is file your answer) in 21 days, that the plaintiff can request the court for a financial judgment against the defendant.
When looking through the summons - it is from a debt collector although the summons seems to be signed by an attorney working for a law firm.
