Q: This is regarding my auto collision claim with my Insurance Provider.

This is regarding my auto collision claim with my Insurance Provider.

On 02/21/24, my Toyota RAV4 hit a deer and caused major damage to my car. My insurance provider is Geico.

I have been advised to take my car to the "Geico Express Facility" Body Shop. I left my car with Body Shop on 02/21/2024.

Bill of estimate was $13,061.79 and expected completion time of the repairs was on 03/19/2024.

I have been calling the body shop since 03/19 and it keeps getting delayed saying that they are waiting for a part and it is in transit.

I dont have my car yet.

I have called GEICO multiple times and spoke with Adjuster and they are suggesting to check with Body Shop.

I would like to know what my rights are in this situation as I cannot keep waiting forever hoping that repairs will be done some day. If there can be any legal course I can follow through to have GEICO held responsible and totale my car if repairs are not done by particular date.

A: I would ascertain what part is "on order," when it was ordered, and where it is coming from. If the part is genuinely "on order," it is unlikely you have a claim against GEICO or the body shop as it is not their fault that the part needed to repair your vehicle has not yet arrived.

I would then see if I can locate the same or comparable part from another source with an earlier expected delivery date. I might even order the part from the other source. When it is delivered, I would take it to the body shop and request that they complete the repair.
