Normally FATE is a 3rd degree felony unless enhanced. If the police intended the vehicle in question to be used as evidence they would have seized it already. Any criminal incident can be reported to the local authorities (sheriff or police) and they will make a report. Once that is done the ultimate filing decision will be made by the state attorney with your input.
