San Diego, CA asked in Car Accidents for California

Q: Are the owner of a vehicle and driver sued differently in the case of an auto accident? If they are served individually?

My sister in law was in an accident driving my vehicle. The owner is now suing us for over $25,000 3 years later. Will we be tried together or separately for this? No one was given a ticket because the Police Officer could not determine who was at fault. Our insurance company already paid the driver $8500 but apparently he wants more.

A: you need to turn the suit papers over to the auto insurance carrier that you had at the time of the accident. they should hire a lawyer for you. typically an owner is only liable if he/she negligently entrusted a driver with the car or the driver was on an errand for the owner. both will be tried together if the case goes that far. one would assume that your insurance co obtained a release before it paid the plaintiff the 8500.. good luck.
