Poway, CA asked in Divorce for California

Q: What recourse when ex uses my sole credit cards/doesnt pay timely, foreclosed rental/adverse credit/cant get loan.

Ex had all mail changed and forwarded to him. He had sole control of community finances during legal seperation and was responsible

for mtgs and debts for past 4 yrs before divorce while seperated. 11 months of this time i had zero support and the rest of time not enough support to pay living expenses let alone legal costs. hes a wealthy physician and investor who after 30 years of marriage gives me 750/mo support. I have no health ins. He encouraged me NOT to work during marriage so besides helping him in his office briefly I havent worked as a nurse in 30 years. Can't rent with little money and lack of recent employment he, can't get a loan with credit report damage he did and foreclosure.

A: First, it sounds like you should be receiving more spousal support. If your ex-husband is actually wealthy and a physician, while you are unemployed, then I would suggest a motion to modify spousal support. The fact that he encouraged you not to work should help you get more support.

Second, if there is already an arrearage in support for the 11 months you received none, you should look into a wage garnishment, bank levy, contempt OSC, or other means of enforcing the order.

Third, I hardly see how he could have charged on your credit cards without your permission. If you are suggesting that he forged your name, you should report it as a crime to the police, and report it as a fraud to your bank.
