Q: If person give resignation as representative do they still have right to collect any incoming cash
If person tell you if have no money has been giving to the estate by a certain date then they are going to remove themselves from the estate. that time arrive and they do just that. But the appointed lawyer tell you when money comes in who she's giving money to but not to the children on estate but to spouse of deceased
A:
It isn't clear whether you are talking about the personal representative getting a commission or getting a share of the estate as a beneficiary.
A personal representative is generally entitled to a commission but gets this money after either the court or the beneficiaries agree to the amount.
As far as giving money to heirs / beneficiaries, the law specifies how money must be doled out if someone dies without a will and lacks enough money to go around. In some cases a spouse may get an allowance which leaves nothing left for others. An attorney would need more details to know whether or not a particular person is entitled to money from an estate.
