Q: If a contract doesn't contain early termination fees, can the company legally demand a termination fee?
A: We would need to read the contract in order to advise. Consult with a local attorney.
A:
If a contract doesn't provide for any sort of termination fee then, as you might expect, it is relatively difficult for the other party to require such a fee. I have dealt with a number of situations where the contract was poorly drafted and the parties agreed (sort of) via email to thing that were not contained in the contract, but which arguably became a part of the contract, so that is something that you have to watch out for. If you are going to speak with an attorney about your situation then you should gather everything related to the relationship with the other party (both good and bad things) and present such to the attorney so that you can get a sophisticated answer about your situation.
