Q: I have a court date for a judgement on a credit bill I cannot afford to pay. I have heard that a credit company can garn
ish wages or put a lein on our home. My question is can the credit card company take our home? its in both of our names and we always pay our mortgage on time.
A: You questions is, as I understand it, whether a company with a judgment against you can at some point force the sale of your home. The answer is maybe. If the judgment is against you alone and you and your spouse own the home as "tenants by the entireties" (a legal status for owning real estate - look at your deed), then they cannot take your home as long as your spouse is alive. If not, then they could try to take your home. There may be ways to protect your home, however, either in the process or separately in a bankruptcy.
