The biggest issues in a workplace harassment claim are:
1. Why you were harassed; and
2. The nature of the harassment.
It is not unlawful for your employer to treat you poorly unless the basis for that treatment is one specifically prohibited by law (e.g. race, sex, disability, etc.). If the harassment occurred on a prohibited basis then you have to look at the severity of the harassment. The courts have set a high standard for harassment claims that requires the harassment to be almost inconceivably severe. The only way to determine whether you have a legitimate claim for harassment is to talk to an employment lawyer in your area who has experience with these claims.
