A: As you overstayed your visa, you have bigger problems than the state ID. You need to get an immigration lawyer ASAP. He or she will work to restore your status, then you can worry about the ID and marriage. If you cannot afford an attorney, the legal aid society in many communities helps with immigration issues. You can also look for an "immigration clinic" at a local law school.

A: Hello,

Most courts will accept any form of valid photo identification (not just a state ID) to obtain a marriage license. This means you can likely use the biographic page of your Jamaican passport as a means of showing your identification. Dependent on the county, you may also need other documents such as your birth certificate and a certified copy of the divorce decree from your prior marriage. You should contact the probate court for this information.

Also, based on the information that you provided, you are currently out of status and may be at risk of deportation. You should contact an immigration attorney as soon as possible for a case assessment and to review your options going forward.
