Q: Can an officer seize legal documents during an arrest that exist to represent yourself in separate civil suit.
The legal documents contained no information related to the accused crime (purpose of arrest) and were in my passenger seat but while the documents were in possession of the police the civil hearing came and I went to it unprepared without my case file. The police would not return it to me after multiple requests and I lost my civil hearing. Is this not interference with due process and/or unwarranted seizure?
A: You are asking if something can be done that has already been done. Now, you claim that you lost your civil hearing because of this. Move for a rehearing with adequate grounds.
