Q: I recently sold my house. Can I use part of the money to pay off my Chapter 13 in a lump sum?

I've only made 3 payments on the bankruptcy so far, but I just put my house up for sale and it sold quickly because a family member bought it. I've read that it is difficult to payoff a bankruptcy early.

A: I assume that you did not call your bankruptcy attorney before you sold the house or you don't have attorney and filed your bankruptcy pro se, because I cannot imagine that a bankruptcy attorney told you that you could sell your home without court approval.

If you have a lawyer, call him/her first thing Monday morning and let him/her know what you did to determine if the problem can be resolved. If you don't have an attorney, make an appointment with an experienced chapter 13 bankruptcy attorney as soon as possible.

You are correct in your belief that paying off a chapter 13 early is difficult, but you may have a much bigger problem on your hands. Act quickly.
