I’m a US citizen and my spouse lives in Denmark. We want to apply for the green card but one of the requirements is me proving I can support him financially by sending an affidavit. The problem is I’m between jobs at the moment and can’t facilitate this. On the other hand, he can provide an affidavit for both of us meanwhile the papers are ready and even afterwards. He is not going to make the jump until he is able to obtain a job here and by that time I will have a job myself. Is it possible for him to provide the affidavit meanwhile, so that we can start the process right away?

A: Take the average income that you have made for at least the last year and state that as your income in doing the affidavit. That is probably the best solution I can come up with right now. Go see an immigration attorney, as well. They rarely answer any questions here.

A: Your question provides with insufficient facts to be answered. An experienced immigration attorney can counsel you with a solution if the attorney has a chance to learn more specific facts about your case. Good luck. www.aba-us.com
