Q: Can I be sued if I did not have commercial insurance while on delivery and the company did not tell me to carry it?
My regular insurance told the other party since i was delivering pizza, their claim was being denied and they are stating that they want to sue. The company that I work for has suspended me until the issue is resolved because they were told other party want to sue them for the damages. My company also did not advised me that I needed maintain commercial insurance on my car while working for them.
A: This is a common problem for pizza delivery drivers. When insurance is purchased by the vehicle owner, there is a question that is always asked. Are you using the vehicle for personal or business uses? If you answer business uses, then your premiums will be higher in the form of a commercial insurance policy. Many pizza delivery drivers do not inform the insurance company that the use of the vehicle changed from personal use to business use. There is a case against you if you were at fault for the accident. As for the pizza company's duty to inform and educate you about insurance, that is an excellent and interesting question. It would be interesting to see the orientation documents that were presented to you. You should consult with an attorney in your geographic area to find out your rights and what can be done about the issues involved. Good luck.
