Q: Chapter 7 Bankruptcy Eviction Question
I live in Texas and I filed Chapter 7 yesterday. I'm also trying to fight an eviction. After I filed and sent the paperwork to the lanlords attorney I was told by their attorney "the Automatic Stay arose when you filed but there is an exception in 11 USC 362(b) which makes it inapplicable to my client." I looked up the code and I'm guessing since Tricon American Homes is owned by Tricon Capital Group is why this applies to them. My question is does this still apply to a company that is Canadian Based and not US Based?
A: I see nothing in section 362(b) pertaining to something called "Tricon". Can you be more specific as to the portion of section 362 to which the attorney was referring?
