Los Alamitos, CA asked in Health Care Law, Juvenile Law and Personal Injury for California

Q: Can my father withhold medication from me?

I am 19 years old and was recently prescribed pain medication after dental surgery. After taking 1.5 pills, my father took the bottle away from me and kept it from me, despite the considerable amount of pain I was still feeling. I finally convinced him to give it back to me, but he tossed all but 3 pills away beforehand. Unfortunately I have developed complications from the surgery, and there may be the possibility that I will need more pain medication after my oral surgeon fixes it. My father has indicated that he plans to take away my prescription again. I do not want to go through this ordeal again if I am prescribed more medication. I would like to know if he can legally withhold the medication prescribed to me/under my name. Again, I am under his health insurance. I am 19 years old.

A: A close question. Technically he is trashing your property. However, you chose to live with him so a complaint to the police may make staying there tough. Is there a relative you can stay with perhaps?
