Q: My dad's fiancee was denied a k-1 visa. Will marrying her speed up the process?

My father's fiancee was denied the K-1 visa because the interviewer believed that it was a sham relationship for her to gain entry into the U.S. My dad is going to Iran (where she is from and currently resides) on Saturday and wants to know if the process to bring her here would speed up if he marries her over there.

A: The processing time remains the same. You can check the USCIS website for the current processing time. If your father is a US citizen, his fiancee may be able to get a K3 visa after they get married but it again depends on how long they have known each other. I suggest having a private conversation with an immigration attorney before leaving to Iran. Many immigration attorneys including me offer FREE consultations, make use of these consultations.
