A: If you are in a crash as the not-at-fault person and were hurt, contact a member of the Ct. Assn for Justice--they give free consultations. If you weren't in the car, the damage should be paid by at fault car's insurance.

If your car is driven by someone at fault, hopefully they have insurance thought the insurance may decline to cover them.

In that case you can make a claim against both but more importantly your license could be suspended. If that is the situtation you need to talk to a lawyer about suspension issues.

A: It would depend on who was at fault for the accident. You state that the person driving your car got in an accident but you don't give any details of the accident. If the person who hit your driver is at fault, then his insurance pays. Hopefully the person driving your car had insurance because you might end up making a claim against the driver's insurance. It might be an uninsured motorist claim if the driver who hit your car had low coverage for liability.
