Q: What does it mean when state picks up a charge? Wy can't I get it dismissed?

Hello, my husband and I had an argument and was in middle of a tug of war basically when cops showed up slamming him on the ground and scratching his head and knees up. Guessing because of his past record from years ago. I did not press charges and talk to prosecutor telling her I don't want to press charges, she said state is picking them up. I was also told to be there in the morning due to being a potential suspect as well. What's our next step? We love each other and are barely ever apart. This is torture for not only me but our 2 boys as well. Please??!! How do I get this dismissed especially the protection order? Do we need an attorney? My attorney moved years ago and I haven't been in trouble so I don't have one at this time. Sane with my husband, he hasn't been in trouble in years. Please, I need to know something???!!!!!! We are going crazy without each other, I'm extremely deoressed, my kids need me and him. NEED HELP!!!

A: Yes, you need a lawyer and so does your husband. The state is planning on pursuing a case against him for domestic violence and you can't make them stop.
