Newnan, GA asked in Education Law, Civil Rights, Juvenile Law and Personal Injury for Georgia

Q: The school has been withholding certain foods and drinks packed for her. Is this legal for them to do?

My daughter attends a lottery funded school in the state of GA. My daughter suffers from a sensory processing disorder which has caused oral texture issues. She has trouble eating foods of certain textures. My daughter is currently being treated by a therapist and closely monitored by a primary care physician whom has written a letter to give to my daughters school to allow us to bring her lunch according to her special needs, which include a food from each category of the food pyramid. The school has been withholding certain foods and drinks packed for her. Is this legal for them to do?

A: Depends on their reason. If they don't have a doctor saying it's inappropriate, then you need to suggest that shouldn't they listen to what a doctor says?
