Q: My son is on my car insurance and has 6 points on his driving record and recently charged with OVI will he lose driving?

If charged with the OVI (Operating Vehicle Intoxicated) and then has 12 points on his driving record, is there a chance the court will grant him driving rights for work purposes? Or will he lose his license and driving privileges for 6 months?

A 12-point suspension is caused by an accumulation of 12 or more points on your driving record within a two-year period.

Reinstatement Requirements

Serve six-month suspension

Complete a remedial driving course

File a certificate of insurance (SR-22/bond)

Pay a reinstatement fee

Retake complete driver license exam

The above information is from BMV website. Is there still a chance the judge will grant suspension with driving permit?

A: The court cannot grant driving privileges on a BMV 12 point except in the limited circumstances of an appeal of the 12 point, or if the reinstatement fee is the last thing that needs taken care of and a time extension is needed to get the money together. Your son should do two things. First, he should hire an attorney to defend the OVI. If he doesn't get convicted of OVI, he doesn't reach 12 points. Second, he should take a remedial driving course. This can provide a 2 point cushion, if done voluntarily, which could keep him reach 12 points, even if he is convicted of OVI. You can find these courses online.
