Q: I have not been paid 5 weeks of pay from an employer who laid me off a month ago. What're my legal options?
We have been delayed pay for 5 weeks due to the fact that the company was not being reimbursed by Medicare due to an error in medicaid numbers. I was laid off. It's been a month since being laid off. I did text them every week since they would not reach me to give me updates. They said that I should've been paid by now legally, they just don't have the money. I am wondering what are my legal options and what do I need to do? This is taking place in Texas. Thank you
A: Contact the Texas Employment Agency (TWC), it will assist you. The employer must pay you on its next regularly scheduled payday after your layoff. It can be subject to stiff fines for not timely paying you. Good luck to you.
