Dayton, OH asked in Criminal Law, Family Law and Child Custody for Ohio

Q: So I just found out that a year ago my child's father tryed to date a 16 year old girl. He's is 26 now. Is this illegal?

The father has no rights to my daughter but is trying to get them. After hearing this I don't want him anywhere near her. Isn't this counted as statutory rape? Is there anything I can do to protect my daughter???? Please help me!

A: First, it isn't statutory rape unless there was some sexual activity, not just dating. Second, the age of consent in Ohio is 16. As 16 year old girl can consent to sexual activity, so, even if there was sex, there was no statutory rape. That's not to say the relationship was proper or you shouldn't be concerned. But, you do not want to go into court and falsely accuse a person of a crime, particularly a sex crime. You would have a defamation lawsuit to defend before you could blink.
