Q: What should I do if I don't get the letter of settlement before my 2nd pretrial?
I made payment arrangements over the phone a week before my pretrial conference. There
I told the lawyer and mediator. The lawyer did not know and he questioned, "and they agreed?" I told them that I was told over the phone I would receive a letter of settlement and to sign and return it. So case is now pending settlement and a new pretrial date scheduled. I haven't received it yet but dI'd get a letter to confirm authorization of recurring transfers from my bank account. What should I do if I don't get the letter of settlement before my 2nd pretrial?
A: Tell the judge and the lawyers, at the pretrial conference, the details of the settlement.
A: I'm guessing that you're talking about a small claims case. First, why not call whoever it was whom you made the payment arrangements to and ask them why you haven't received the settlement letter. Also, as Mr. Thorgaard answered, when you go to the pretrial conference, explain it to the court and to Plaintiff's attorney. Good luck.
