Fort Myers, FL asked in Insurance Bad Faith and Consumer Law for Florida

Q: IN FL, IF NOT EXCLUDED BY NAME, MUST AN AUTO POLICY COVER WHEN A FRIEND IS DRIVING?

IN FLORIDA, MY KIDS NANNY WAS TAKING DRIVING LESSONS ON HER OWN WITH THE NEIGHBOR IN THE NEIGHBOR'S CAR (PAYING FOR THE LESSONS). ON THE SECOND LESSON SHE WENT OVER THE PARKING CURB AND DAMAGED THE CAR. WHO IS LIABLE? HE IS CLAIMING HIS POLICY WON'T COVER IT BUT I THINK HE DOESNT WANT TO FILE A CLAIM BECAUSE HE DOESNT WANT HIS RATES TO GO UP AND SO HE IS ASKING FOR THE FULL AMOUNT AND I WANT TO PAY THE DEDUCTIBLE. THANKS

A: The neighbor is asking you or your nanny to pay the damages? I don't think you are liable, although the nanny may be, so why do you want to pay the deductible? Your nanny should ask to see the policy to verify if the damage is covered.
