Q: My question is in regards to employee insurance

My husband work full time for a company he has no health insurance. There are other employees doing the same job as him and they have health insurance through the company. This company seems to pick and choose who they offer health insurance to instead of making it available to all employees. My husband was recently in the hospital and now we have a huge bill to pay and they still don't offer him any insurance. Is it legal for them to do this?

A: Probably not. There are questions of whether he is discriminated against due to age or some protected classifications. Need more facts

Second if policy health insurance is available to all employees and they fail would be breach of contract and maybe Erisa violation.
