Q: In md ...Is there a way to transfer a property deed if one of the three co-owners can not be found?
This is an in family transfer.
A:
Yes, but it may be complicated.
If there is any way at all to track down the missing owner (and usually there is) they will need to be reached. That being said, a joint owner can petition the court for something called "sale in lieu of partition" to force a sale / transfer. The person who files the case will need to track down and find the missing owner, or if all efforts to track through private investigators and such have been exhausted they may petition the court to proceed with service through some other means like publishing in the newspaper.
If, however, 2 owners of property want to transfer their interests to someone else in the family, that can be done relatively easily without involving a missing third owner. Of course, they can only transfer what they own but 2/3 of the owners can generally transfer 2/3 of the property by signing a new deed.
