Q: What's the definition of no-fault divorce and will it effect the support I get?
A: Child support is based upon the child support guidelines and there is no difference as to whether fault is involved for support of children. Spousal support is generally tagged to the length of the marriage and various factors having to do with the parties circumstances, is governed by a specific statute for the determination of whether either party should pay same and fault does not have to be alleged for same. Spousal need and ability to pay are important considerations and sometimes a party gives up income to avoid paying support and there can be income attribution by the Court.
