Q: My brother had a car accident that left him in pretty bad shape the other driver i believe is trying to sue
My brother has no knowledge of that night what so ever and he has no insurance i need help trying to guide me on what to do

If the other party is suing your brother, they must first serve the complaint on them. This is usually done by having a third-party give the complaint against him in person, although it can be accomplished in other ways if a court allows it. Once your brother receives the complaint, he must respond or a default judgment may be entered against him in court.
From what you said, it is not clear why you think the other driver is trying to sue. With that said, under California Vehicle Code Section 16029, it is illegal to drive a vehicle without evidence of financial responsibility such as insurance. So, your brother should go to a lawyer to see how to handle this situation. If your brother says something like, "I don't have insurance" hoping that he won't be sued, it could lead to other problems.
